Madison Caught In Leagl Battle Over Adult Entertainment

The City of Madison will be in the court of appeals over the issue of freedom of speech. The outgoing city attorney stated, “This is an issue of the right of a city zoning board and the regulations inherit to a city charter. This is not a question of the first amendment”. The Nighttime Entertainment Company has argued the opposite. “This is a question of our freedom of expression and speech. If the City of Madison can do this to us, who is next”, stated the owner of Nighttime Entertainment. He believes in this so much, that he is seeking a high-powered lawyer to fight the city at whatever cost. The outgoing circuit court judge, Henry Gross, ruled that the city has the authority to approve or deny requests based on its master plan. After this ruling the Nighttime Company wasted no time in filing an appeal to this decision. “This might be an issue the Supreme Court will decide”, said one Law Professor. Some resident are hoping the city and Nighttime Entertainment will come to some type of agreement forgoing the heavy court costs to both sides. With the elections coming this battle may continue or will it be resolved?
